4. QR Code Apparel and Messaging Services

4.1 QR Code Ownership and Usage

Each piece of Qrrious apparel contains a unique QR code linked to your account. You understand and agree that:

• The QR code on your apparel is uniquely associated with your Qrrious account
• You are responsible for managing your QR code settings, including who can scan your code and send you messages
• You should exercise caution regarding where and when you wear your Qrrious apparel, as the QR code can be scanned by anyone with a compatible device
• While we implement security measures, we cannot guarantee that your QR code will not be replicated or misused by third parties

4.2 Anonymous Messaging

Our Services allow users to send and receive messages, including anonymous messages, after scanning a QR code. You understand and agree that:

• When you send an anonymous message, your identity is not revealed to the recipient, but Qrrious maintains records of who sent each message
• You are solely responsible for the content of messages you send
• We reserve the right to review message content to enforce our community guidelines and Terms
• We may disclose the identity of anonymous message senders in response to legal requests or to investigate violations of our Terms
• Recipients of your messages may block you or report inappropriate content

4.3 Message Content Restrictions

You agree not to use our messaging services to send content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights
• Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
• Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," or any other form of solicitation
• Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity
• Contains personal or identifying information about another person without their explicit consent

5. Product Purchases

5.1 Product Information

We strive to display our products and their colors as accurately as possible. However, we cannot guarantee that your computer or mobile device's display accurately reflects the actual color of the products.

5.2 Pricing and Payment

All prices are shown in the applicable currency and do not include taxes and shipping costs, which are added at checkout. We reserve the right to change prices at any time. Payment must be made through the payment methods we offer.

5.3 Shipping and Delivery

Shipping times and costs vary based on location and shipping method selected. We are not responsible for delays caused by customs, postal services, or other circumstances beyond our control.

Our return and refund policy is available on our website. Please note that due to the personalized nature of QR code apparel, certain items may not be eligible for return or exchange.

The Services and their original content, features, and functionality are owned by Qrrious and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 License to Use

6.3 User Content

You retain ownership of any content you submit, post, or display on or through our Services. By submitting, posting, or displaying content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, modify, publish, translate, distribute, and display such content in connection with providing our Services.

7. Prohibited Uses

You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To impersonate or attempt to impersonate Qrrious, a Qrrious employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our Services
• To use our Services for any harmful or malicious purpose
• To use our QR codes or messaging system for spam, harassment, or illegal activities

8. Disclaimer of Warranties

YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QRRIOUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Qrrious and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Services shall be instituted in the federal or state courts located in San Francisco County, California.

12. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.
